This Guest Rental Agreement, “Agreement” is made  Current Date between:

You, The Guest

(Hereinafter the “Tenant”), and Prista Management authorized owner representative (Hereinafter “Owner Representative”) concerning the short term rental of the property located at:

WITNESSETH:

THAT for and in consideration of the covenants, contract, terms, provisions and conditions herein set forth, including but not limited to, Owners Representative’s short term rental of the Premises to Tenant, the parties do hereby mutually agree, each with the other, as follows:

OccupancyThe Property is to be occupied by no more than 8 persons at a maximum. In addition, the Property is to be occupied by no more than 6 adults (18 years of age or older). The Property cannot be occupied nor Agreement executed by persons under the age of 25. Occupants under the age of 25 must be accompanied by an adult guardian or parent. We also require a list (name & ages) of guests that will be occupying the property, as well as, a copy of the driver’s license of the guest over age 25 executing this booking.

Check-In: 4PM Check-Out: 10AM

We will grant you access to our Property at 2PM on your date of arrival. Please note that while we will grant you access 2 hours before the 4PM check-in time, it is not guaranteed cleaned until 4PM. Please be conscious of this and considerate of our cleaning staff in the event that you run into them. We are always pleased when our guests can access our property early.  Unless otherwise agreed to in writing, Guest shall vacate the Property no later than the check-out time on the departure date. No exceptions. Failure to depart the suite prior to 10AM on the date of your departure will result in a late check-out charge against your Refundable Security Deposit.

NO PETS are permitted on the Property.

There shall be NO SMOKING at the Property. THIS INCLUDES THE BALCONY. See Use of Property below.

Accidental Damage Protection

Tenant is required to secure Property with Accidental Damage Protection that covers unintentional damages to the Property that occur during the Tenant’s stay provided damages are disclosed to Prista Management prior to your check-out.  The Accidental Damage Protection will pay a Maximum Benefit of $500.  Any damages that exceed $500 will be charged to the credit / debit card on file.  If, during your stay at the Property, you and/or one of your traveling party causes any damage to the real or personal property of the Property as a result of inadvertent acts or omissions, Prista Management will cover the cost of the repair or replacement of such property up to $500 (USD), subject to certain terms and conditions that apply.  The Accidental Damage Protection must be purchased at the time of reservation.

In addition to the Accidental Damage Protection, we reserve the right to authorize $300 to the credit / debit card on file.  Guest shall leave the Property in a ready to rent condition at the expiration of the rental agreement, defined by the Owner Representative as being immediately habitable by the next guests AFTER normal housekeeping services.  See Bed Linens, Towels, Supplies, & Departure Instructions and Use of Property below for additional clarification.

Payments

A $300 payment is due at the time of booking. Payments of all balances owed are due 60 days prior to your date of arrival. If making a reservation within 60 days of your date of arrival, full payment is due at the time of booking. Payments are permitted by (1) E-Check or (2) Credit Card (Visa, MasterCard, and Discover). Payment by credit card is required if Guest date of arrival is within 14 days. Payments of all balances owed 60 days prior to Guest date of arrival will automatically bill the same form of payment used at the time of booking by either E-Check or Credit Card. An email reminder will be sent 5 days prior to Guest payment due date. Please email us to update or change your form of payment. Contact Owner Representative if you would like to set up a different method of payment (mail a check, money order, etc.).

Cancelation Policy

Owner Representative will refund rental deposit payments made (less a $30 administrative fee) if Owner Representative receives notice of cancelation at least sixty (60) days prior to the arrival date for daily & weekly rentals and at least one-hundred twenty (120) days prior to the arrival date for monthly rentals. For cancelations within sixty (60) days of the arrival date for daily & weekly rentals or within one-hundred twenty (120) days for monthly rentals, Owner Representative shall have the right, at its discretion, to retain any rental deposit payments made, to be held for lost rent and potentially result in forfeiture of any rental deposit payments made, unless the rental unit is rebooked for the same rental period and amount. There shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions or due to work and family emergencies or other commitments.  Owner Representative recommends the purchase of Rental Guardian Trip Cancelation and Travel Insurance protection.  By signing below, you acknowledge that you have read and understand our cancelation policy.

Rental Guardian Trip Cancelation and Travel Insurance

Rental Guardian Trip Cancelation and Travel Insurance is intended to provide protection to you against losses for certain pre-paid non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your travel investment and force you to incur unplanned additional costs.  Prista Management cannot refund rental deposit payments due to circumstances beyond our control, including but not limited to hurricane or storm-caused evacuations, road closures, inclement weather, or any illness or injury to someone within your traveling party that may cause you to cancel your trip.  For these reasons, we recommend that you purchase this valuable protection, which includes benefits such as medical coverage, travel delay benefits, 24/7 emergency services and more (described in full in specific program documentation we will provide you upon request).  The purchase of this Trip Cancelation and Travel Insurance is optional.  The cost is 7% of your Total Rental.

Bed Linens, Towels, Supplies, & Departure Instructions

Bed linens, blankets, pillows, and towels are provided, along with a starter supply of hand soap, dish soap, dishwasher detergent, paper towels, and bathroom tissue. Daily housekeeping services are not offered unless separately arranged with Owner’s Representative. If additional cleaning is needed after your check out, any items that are damaged or missing (including linens), or furniture repositioned, you will be charged for the additional cleaning service and/or missing items. Guests are responsible for removing all open food from the refrigerator and cabinets, loading dirty dishes into the dishwasher and running it, placing garbage in the outside receptacles or garbage chutes. Please do not remove bed spreads or mattress pads and do not remake the beds.

Use of the Property

Guest shall maintain the Property in a good, clean, and ready to rent condition, and use the Property only in a careful and lawful manner. Guest shall leave the Property in a ready to rent condition at the expiration of the rental agreement, defined by the Owner Representative as being immediately habitable by the next guests AFTER normal housekeeping services. Guest shall pay for maintenance and repairs should the Property be left in a lesser condition. Guest agrees that the Owner Representative may deduct costs of said services from the Security Deposit prior to refund. Guest understands that any damages which are discovered to exist, or which occur during the Guest occupancy should be reported at the earliest possible time to the Owner Representative.
Guest shall inventory the furnishings, housewares, and appliances upon arrival and notify Owner Representative as soon as reasonably possible if any items are damaged.
Guest shall pay for any damage done to the Property over and above normal wear and tear. Guest agrees that the Owner Representative may deduct costs of replacement or repairs from the Security Deposit prior to refund if Guest causes damage to the Property or its furnishings.

There shall be NO SMOKING inside the Property. THIS INCLUDES THE BALCONY. Smoking inside the Property shall be grounds for immediate termination of this Agreement, upon which Guest shall immediately vacate the Property. Owner’s Representative shall not be liable for the refund of any rents or deposits for termination pursuant to this section.

Guest shall learn about safety precautions, warning signs of water conditions, and safety procedures concerning swimming in or being around the pools at the resort. Guest is hereby notified that the pools can be dangerous and Guest expressly assumes any and all risks involved.

Guest shall abide by the Property Owner’s Association rules and regulations applicable to occupancy of the Property and the resort. Guest understands that the management of the resort has the right to demand that Guest immediately vacate the Property if it determines, in its sole discretion that Guest or its invitees are in gross violation of said rules and regulations. In the event the management of the resort makes such a demand, this Agreement shall immediately terminate and Guest shall immediately vacate the Property. Owner Representative shall not be liable for the refund of any rents or deposits for termination pursuant to this section.

Additional Terms and Conditions

Should Guest violate any of the terms of this Agreement, then Owner Representative, at its discretion, may terminate Agreement immediately and Guest shall vacate the Property. Owner Representative shall not be liable for the refund of any rents or deposits for termination pursuant to this section.

Owner Representative shall not be responsible for providing any additional furnishings or equipment not presently in the Property.

Owner Representative and Owner have the right to inspect the Property at reasonable hours without prior notice at any time to enforce the terms of this Agreement. Repair Personnel may enter the Property at reasonable hours for the purpose of necessary repairs and inspections. Every effort is made to maintain the accommodations in good repair. All repairs will be handled as quickly as possible.
Guest shall not sublet the Property.

GUEST AGREES TO DEFEND, INDEMNIFY, AND HOLD HARMLESS OWNER REPRESENTATIVE AGAINST ANY AND ALL CLAIMS, DEMANDS, LIABILITY, LOSS OR EXPENSE OF EVERY KIND AND NATURE, INCLUDING REASONABLE ATTORNEYS FEES AND OTHER EXPENSES OF LITIGATION, BECAUSE OF ANY INJURY TO OR DEATH OF PERSONS OR DAMAGE TO PROPERTY (INCLUDING GUEST’S PROPERTY) WHICH OCCUR AS A RESULT OF THE SOLE NEGLIGENCE OF THE GUEST IN CONNECTION WITH USE OF THE PROPERTY OR BY REASON OF GUEST OR ITS INVITEES BEING PRESENT ON THE PROPERTY, REGARDLESS OF OWNER REPRESENTATIVE FAULT OR NEGLIGENCE OR STRICT LIABILITY, EXCEPT TO THE EXTENT THE TOTAL LIABILITY, LOSS OR DAMAGE IS ATTRIBUTABLE TO AND CAUSED BY THE SOLE AND EXCLUSIVE NEGLIGENCE OF THE OWNER REPRESENTATIVE, OR EXCEPT TO THE EXTENT AS LIMITED BY APPLICABLE LAW.

Guest expressly recognizes that any insurance for property damage or loss maintained on the Property does not cover the personal property of Guest, and that Guest should purchase insurance if any such coverage is desired.

Guest agrees to pay all reasonable costs, attorney’s fees, and expenses that shall be made or incurred by Owner Representative in enforcing this Agreement.

Guest expressly acknowledges and agrees that this Agreement is for transient occupancy of the Property, and that Guest does not intend to make the Property a residence or household.

Valuable items left behind by Guest will be held for the Guest and every reasonable effort will be made to contact the Guest for return. If items are not claimed for longer than 6 months they shall become the property of the Owner Representative. The Owner Representative shall not be held liable for the condition, loss of, or damage to said items.

This Agreement represents the entire understanding and agreement between the parties hereto and supersedes any and all prior terms, conditions, understandings, or contracts, whether written or oral, that may exist between the parties regarding the rental of the Property.

The provisions of this Agreement are severable, and if any clause or provisions hereof shall be held invalid or unenforceable in whole or in part, then such invalidity or unenforceability shall not affect any other clause or provision in this Agreement.

Any waiver by either party of any provision or condition of this Agreement shall not be construed or deemed to be a waiver of any other provision or condition of this Agreement, nor a waiver of a subsequent breach of the same provision or condition, unless such waiver is expressed in writing and signed by the parties. Delay in the enforcement of any remedy in the event of a breach of any term or condition, or in the exercise by either party of any right, shall not be construed as a waiver of such remedy or right.
